Terms of Service

These terms (the “Terms”) govern your use of Freedom by Design (“Emboulden,” “we,” “us”), including the free course site and the member app at emboulden.com. By using the service, you agree to these Terms. If you don’t agree, please don’t use it.

1. What we offer

Emboulden is a self-guided personal-finance workbook and journaling tool with an AI assistant. It’s educational. It is not, and should not be treated as, professional financial, legal, tax, medical, or mental-health advice.

2. Not financial advice

We do not hold any financial, investment, tax, or legal licenses. Nothing on this site, in the journal prompts, in goal suggestions, or in conversations with the AI coach is personalized financial advice or a recommendation to buy, sell, or hold any specific security or product. Before making any financial decision, consult a qualified professional.

3. Not mental health treatment

The journal prompts and AI coach may touch on emotional topics. They are not therapy, counseling, or any form of mental-health treatment. They are not a substitute for care from a licensed clinician. If you are in crisis or need urgent support, please see our crisis resources page or call 911 (or your local emergency number).

4. AI output can be wrong

The AI features use a large language model. Its responses may be inaccurate, out of date, or inappropriate for your situation. Always verify anything the AI tells you before acting on it.

5. Eligibility

You must be at least 18 years old to create an account. By creating an account, you confirm that you are.

6. Your account

Keep your password private. You are responsible for activity on your account. Tell us at info@emboulden.com if you suspect unauthorized access.

7. Acceptable use

You agree not to:

• Use the service to harass, threaten, or harm others.
• Attempt to manipulate the AI to produce content that violates law, is targeted at a specific person, or facilitates self-harm or harm to others.
• Reverse-engineer, scrape, or attempt to access data belonging to other users.
• Use the service to send spam or otherwise abuse the AI-usage limits.

We may suspend or close accounts that violate these rules or that we reasonably believe are abusive.

8. Your content

You own what you write — your journal entries, coach messages, and goals. You grant us a limited license to host, process, and display that content solely to operate the service for you, including by sending it to our AI provider to generate responses. See the Privacy Policy for details.

9. Our content

The course content, prompts, calculators, and software are owned by Emboulden and protected by copyright. You may use them for your personal, non-commercial use through the service.

10. Fees

The service is currently free during alpha. We may introduce paid tiers in the future; if we do, we’ll give you reasonable notice and you can decide whether to subscribe.

11. No warranty

The service is provided “as is” and “as available.” We disclaim all warranties to the fullest extent allowed by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that the service will be uninterrupted, error-free, or that AI output will be accurate.

12. Limitation of liability

To the maximum extent allowed by law, Emboulden will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the service. Our total liability for any claim arising out of the service is limited to the amount you paid us in the twelve months before the claim, or US $100, whichever is greater.

13. Termination

You may close your account at any time by emailing us. We may suspend or close your account if we reasonably believe you’ve violated these Terms or if we discontinue the service. On termination, the rights granted to you here end, but sections that by their nature should survive (e.g., ownership, disclaimers, liability limits) will survive.

14. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute will be brought in the state or federal courts located in California.

15. Changes

We may update these Terms as the product evolves. We’ll update the “Last updated” date above. Material changes will be communicated by email to active members. Continued use after a change means you accept the updated Terms.
